Xiaomi will pay 200,000 euros to show three mobiles in the MWC for a Spanish demand



The Chinese company has entered this bond after the accusation of the Spanish Tot Power Control of infringing its intellectual property rights



   The Spanish company Tot Power Control has filed a suit for infringement of its patents against the Chinese giant Xiaomi, which must pay a deposit of 200,000 euros to exhibit at the World Mobile Congress (MWC, in its acronym in English) the 3 mobile phones under Suspect: the Redmi Note 5A, the Mi A1 and the Mi Mix 2.

The Madrid-based company accuses the Chinese group of infringing its intellectual property rights for allegedly incorporating technology patented by it in Europe into some of its devices.

The patent in question is called ES'243 and refers to "a method and device for the external loop power control system in a cellular mobile telephone network".

Tot Power Control, a division of the company Top Optimized Technologies, has taken the case to court and has requested that Xiaomi be prohibited from "carrying out acts of sale, use, promotion, dissemination and exhibition" of the models that ensure that they have the infringing technology during the Mobile World Congress, the main world meeting for mobile telephony, which takes place from 26 to 1 March in Barcelona.

    The case has fallen into the hands of the Mercantile Court No. 4 of Barcelona, ​​which considers, after analyzing the documentation provided by Tot Power Control, that "rational signs of a possible infringement" of the rights of the patent holder actually occur.

The judge, however, considers that the measures requested by Tot Power Control "are burdensome for Xiaomi", taking into account that in this congress "commercial agreements of great economic importance for the participants are closed".

"And prohibiting the defendant from selling, displaying or commercializing the referred mobile devices would cause damage probably greater than the one to be avoided," Judge Alfonso Merino states in his ruling.

Xiaomi has already paid the deposit
The magistrate warns that even "the plaintiff could be harmed" by the ban on exhibiting mobiles during the MWC, since this would "reduce the economic capacity of Xiaomi itself for a possible compensation of damages in favor of Tot Power Control in the main process ".

Therefore, the judge chooses to issue precautionary measures and set a deposit of 200,000 euros for Xiaomi if he wants to show the public in Barcelona the mobile models Redmi Note 5A, Mi A1 and Mi Mix 2, three of the most popular of the brand.

The manufacturer has already paid this deposit, so you can display your mobile devices in the Barcelona congress normally, waiting for a judge to decide on the merits of the matter.

The Superior Court of Justice of Catalonia (TSJC) has recently activated the guard and rapid action protocol for the Mobile World Congress that seeks to respond to conflicts that may arise between the companies participating in the event in relation to the brands and patents.

This is the fourth year in a row that the high court has launched this service that affects the mercantile courts of Barcelona.
